Terms & Conditions

 

The below terms and conditions are set out by Friends of the Award in Edinburgh & the Lothians (FOTA), who own and distribute the Junior Award Scheme for Schools (JASS), eJASS, and all associated materials. By ordering JASS, you are agreeing to abide by these Terms and Conditions.

  1. Ordering Process

    1. Orders can be received via the online JASS order form, or by printing and returning the JASS order forms by post or email. FOTA are able to take initial orders over the phone however we request that all phone orders are followed up with written confirmation via email.

    2. City of Edinburgh Council orders should be placed via the Oracle System. The Oracle system is not controlled by FOTA and so there may be a delay in FOTA receiving the order through Oracle. FOTA are not responsible for any delays in receiving orders placed through Oracle.

    3. FOTA aim to process all orders within 3 business days of order receipt. If customers do not hear from FOTA within this period it is recommended that customers contact the FOTA office to ensure that the order has been received. This timescale may become extended during busier times, however FOTA will endeavour to contact customers if there is likely to be a delay to an order.

  2. Delivery

    1. For orders out with City of Edinburgh Council, JASS products are delivered through selected 3rd party couriers. Although FOTA aim to fulfil delivery within 5 working days of invoice, this can vary depending on the courier service used and may take up to 14 days. FOTA will endeavour to ensure that delivery is made within the time stated, and will notify customers as soon as possible should their delivery promise not be met.

    2. For orders within the City of Edinburgh Council, JASS products are delivered through the City of Edinburgh internal mail system. Although we aim to fulfil delivery within 10 working days of invoice, this can vary depending on the availability of the internal mail system, and may take up to 20 days. FOTA will endeavour to ensure that delivery is made within 10 days, and will notify customers as soon as possible should this delivery promise not be met.

  3. Pricing, Invoicing, & Payments

    1. Prices are correct as of the order submission date & subsequent invoice.

    2. FOTA have the right to issue a new invoice for orders not paid within 30 days of customers receiving the order. After 30 days FOTA hold the right to issue subsequent invoices with amended prices should the price change in the interim period.

    3. FOTA hold the right to add an additional administration charge of 5% to any invoices not paid within the initial 30 day period.

    4. Payments can be made via cheque or direct bank transfer. There is no additional charge for processing these payment methods.

  4. Returns & Rights to Cancellation

    1. JASS orders may be cancelled up to 14 days after receiving the order. In this instance all return postage costs must be paid by the customer

    2. Customers wishing to cancel an order should do so using our order cancellation form, which are available by contacting the FOTA offices via phone or email.

    3. In the event of cancelling the order the customer has a further 14 days to send the items back to FOTA. Items must be received back in original condition, with a copy of the cancellation form.

    4. Refunds will be made within 14 days of receiving the returned goods at FOTA.

  5. Incomplete or Incorrect Orders

    1. If an order is received either incomplete or incorrect then please contact the FOTA office within 3 business days of order receipt. FOTA will rectify any errors as soon as possible, either by replacing the missing items, offering a reduction in price, or returning the order.

    2. There is no additional charge for rectifying incomplete or incorrect orders.

  6. Faulty Goods

    1. Any items received or that become defective within 6 months of the delivery date will be replaced free of charge by FOTA, or a full refund will be offered on these items. This does not include wear and tear of items through standard use.

    2. Any items that are wilfully damaged or lost at any time, or become defective out with the 6 month period can be replaced by FOTA for a small charge. Please contact the FOTA office in the first instance.

  7. Intellectual Property Agreement

    1. The accredited learning programme Junior Award Scheme for Schools (JASS), eJASS, and all associated materials are the intellectual property of Friends of the Award in Edinburgh & the Lothians (FOTA). Reproduction of any associated materials without the express permission of FOTA is strictly prohibited.

    2. Use of JASS / eJASS logos and associated branding is only to be carried out in line with the Brand Guidelines, which are available on the JASS website.

    3. The JASS programme must only be delivered in-line with the set guidelines, using original materials.

    4. JASS accreditation is devolved to the school / organisation delivering the programme on condition that an accreditation officer is appointed, and that person has no direct involvement in the programme delivery.

  8. Data Protection

    1. In order to carry out our work, FOTA collects and use certain types of information about our customers. This data is collected and stored in accordance with the Data Protection Act (1998).

    2. To ensure JASS /eJASS is delivered consistently across all registered centres, FOTA may ask to see participants evidence within the JASS folders or within eJASS accounts. We may use this data for evidencing the benefits of JASS to our funders as well as to develop case studies and best practice with other JASS centres, through our online channels and other materials.

    3. FOTA may share information gathered with selected partners in order to improve the service received by JASS customers. In doing so, all data will be anonymised to ensure that no individual will be identifiable from the results. Customer data will never be sold on by FOTA to any third party.

    4. Information and records relating to customers will be stored securely and will only be accessible to authorised staff and volunteers.

    5. All customers have the right to access the information held about them by FOTA. FOTA will also take reasonable steps ensure that this information is kept up to date by asking data subjects whether there have been any changes.

  9. Our Liability

    1. All activities delivered towards JASS are run at the school / organisations own risk, and as such any documents, risk assessments, as well as the recruitment and suitability checks of all activity staff are the responsibility of the school / organisation. FOTA are not responsible for any injury or fatality to individuals, or damage to property that occurs during these activities.

  10. Queries & Grievances

    1. Any queries or grievances regarding your experience with JASS should first be brought to the attention of the FOTA staff team. We aim to respond to grievances within 10 days of initial receipt, however we may ask for up to 4 weeks should a more detailed investigation be required. Should our initial response to the grievance not be satisfactory, grievances may be taken to the FOTA Board of Trustees by post to:
